Transfer Procedures

Introduction

The procedure is laid down to provide guidelines for smooth transfer of plots. It is expected that these guidelines will provide the essential information for all transfer-related issues. The transfer procedure is reviewed and updated regularly. Members are therefore advised to obtain any additional information from authorized officers of Defence Housing Authority Islamabad prior to the sale/transfer of a plot.

Procedure to Find Out Dues

To ascertain the amount to be paid by seller and purchaser for transfer of plot, the owner (seller) will deposit a request for dues in the Finance Directorate, which will prepare the statement of dues, giving details of outstanding dues/payments and transfer charges. The statement of dues will be handed over to the applicant or his authorized property dealer/purchaser. The following documents must be deposited to obtain the statement of dues:

  • Request for the issue of a statement of dues.
  • Attested photocopy of CNIC of the owner and purchaser.
  • Attested photocopy of the allotment letter.
  • Authority letter issued by the owner authorizing a person to collect the statement of dues (property dealer/purchaser), if the seller is not available personally.

Deposit of Dues

Dues may be deposited in any branch of Askari Commercial Bank on pay-in-slip or through bank draft/pay order. Outstation pay orders are not accepted. No charges/dues will be accepted in cash or by cheque.

Procedure to Obtain No Demand Certificate (NDC)

In order to obtain an NDC, the owner (seller) has to apply personally or through his authorized representative property dealer to the Finance Directorate. The NDC will be issued to the seller or authorized representative/property dealer by the Finance Directorate.

Deposit of Transfer Papers

Transfer papers will be deposited by the seller/purchaser or their representative to the Legal Directorate, where these will be scrutinized. Errors, observations, and shortcomings will be pointed out by the Legal Directorate to the depositor of papers. It is the responsibility of the seller/purchaser/authorized representative to correct all errors and remove observations and deposit error-free transfer papers. Transfer time will be given on a first-come, first-served basis. The Legal Directorate, if satisfied with the transfer papers, will issue the transfer number for the next day.

Transfer of Plot by Seller

The following documents are required for the transfer of a plot in the presence of the seller/purchaser:

  • Transfer application form.
  • Original allotment letter.
  • No Demand Certificate (NDC).
  • Transfer affidavit by the seller on judicial stamp paper along with two photocopies, duly attested by the Oath Commissioner.
  • An undertaking related to the payment of development charges is required to be given by the purchaser on judicial stamp paper, duly attested by an Oath Commissioner.
  • Agreement to sell a plot on judicial stamp paper attested by Notary Public/Oath Commissioner.
  • Application form for Membership/Associate Membership with two passport size colored photographs.
  • Attested photocopies of CNICs of the seller and purchaser.
  • Attested photocopies of CNICs of two witnesses.
  • Original copy of the statement of dues received from the account office.

Transfer of Plot on General Power Attorney (GPA)

The following are the documents required for the transfer of a plot in case the member resides outside the country:

  • Transfer application form.
  • Approval letter for GPA Transfer.
  • Original allotment letter of the plot.
  • No Demand Certificate (NDC).
  • Transfer affidavit by the GPA holder (including one photocopy duly attested by Oath Commissioner on Stamp paper).
  • Undertaking by the purchaser for additional charges, dues/taxes on judicial stamp paper duly attested by Oath Commissioner.
  • Application for membership/associate membership of the transferee/purchaser along with two passport size photographs.
  • Photocopies of the CNIC of the executer of GPA (Seller)/GPA holder/ purchaser.
  • Photocopies of CNICs of two witnesses.
  • Original copy of the statement of dues received from the account office.
  • Validity certificate of GPA from Registrar District Courts, where GPA is registered.
  • GPA in original.
  • Agreement to sell a plot on judicial stamp paper duly attested by Notary Public/Oath Commissioner.

Transfer of Plot in the Name of Legal Heir

The following procedure is required for the transfer of a plot in the presence of a legal heir:

  • Transfer application form.
  • Original allotment letter.
  • No Demand Certificate (NDC).
  • Transfer affidavit by the surrendering of rights by each legal heir (including two photocopies duly attested by Oath Commissioner on judicial stamp paper).
  • Undertaking by the legal heir, in whose name the plot is being transferred, for additional charges, dues/taxes on judicial stamp paper duly attested by Oath Commissioner.
  • Application form for membership/associate membership by the legal heir of the deceased with two passport size photographs.
  • Original copy of the statement of dues received from the account office.
  • Succession certificate from the court or Varasat Nama from Tehsildar (showing the legal heirs including parents).
  • Guardianship certificate (in case of minor children).
  • Death certificate of the deceased, duly attested.
  • Photocopies of CNICs of all legal heirs.

Transfer of Plot by Means of Gift/Hiba

The following documents are required for the transfer of a plot in the presence of the donor/donee:

  • Transfer application form.
  • Original allotment letter.
  • No Demand Certificate (NDC).
  • Transfer affidavit by the donor (including two photocopies duly attested by Oath Commissioner on judicial stamp paper).
  • Affidavit by the donee for acceptance of the gift on judicial stamp papers.
  • Undertaking by the donee for additional charges, dues/taxes on stamp paper duly attested by Oath Commissioner.
  • Application for membership/associate membership of the donee.

Members Suffering From Physical Disability

The member desiring to transfer their plot, if suffering from a disease/physical disability within the country, can adopt the procedure for Outstation Transfer by producing a medical certificate. The outstation transfer fee is Rs. 15,000, and the cost of traveling for representative officials to the residence of the member and back shall also be borne by the member.

Receipt of Allotment Letter

The allotment letter will be given to the owner after seven working days from the transfer. It may be issued on an urgent basis subject to the submission of a fee of Rs. 10,000 within 24 hours and Rs. 5,000 within 72 hours. The fee for the issuance of an urgent allotment letter will be reviewed by the authority from time to time.

Issue of Allotment Letter on Authority Letter / Courier Service

A member may authorize someone to collect the allotment letter on their behalf by giving an authority letter, or the letter may be dispatched through registered courier by producing a risk certificate. A fee of Rs. 5,000 will be charged in either case.
